A fine (i.e. a stupid) upstanding (i.e. a coward) if extremely shy BNP supporting white racist "revolutionary"*

*"Revolutionary" as in: a white racist BNP supporter of political or social revolution of a racist (segregationist, white supremacist, pig ignorant bullshit) nature.     

n.b. Appearing in court on behalf of the State prosecuting authorities suited and booted and - hilariously (my my my how far the once "mighty" seem to have fallen!) - positioned hiding behind a sight blocking partition, provided at my and your i.e. the public's - expense.

That being as a result of the content of your FB posts from Sept. 2012 to Jan. 2013 in conjunction with specific (and quoted) content of your 10. Jan 2013 statement made to ATVP under caution (sic)  

n.b. A complete transcript of the magistrates' court's judgement handed down (and the corresponding sentence when handed down) will be obtained and published in due course, alongside the defendant's evidential bundle and the witness statement "evidence" of the CPS's witness, and all other relevant public trial documents used to convict and/or in defence of the convicted criminal who is the author of this blog.

On 26/6 I have made it clear to HMCTS system that I wish to proceed to trial on 11/7 to answer the CPS's 15/3 charge brought against me.

Re: Colin Jarvis's 12 Dec. 2006 public protest outside BT Centre EC1A 7AJ. 

The right to legitimate and lawful peaceful public protest (with placards and accompanying identifying photos, names and verbatim quotes from the CWU members / BT employees concerned) which is every citizen's right, will AGAIN be exercised by this black British citizen post 11/7/2013.

I am hopeful that good decent and honest black people and good decent and honest white people people, in possession of mass communication social media devices, will bare witness to this British black man's public protest demonstration.

A Personal Statement.

I believe all my social media sites content to be lawful, legal, legitimate accurate and factual information postings in the form of honest comment. I refute any and all assertions of any criminal harassment of any other person or entity.

The entirity of my social media content is: Honest comment, fair comment, fair opinion and the exercise of my freedom of expression as described within Article 10 of the ECHR.

It should be noted that my fair opinion and comment, my honest comment, honestly held and honestly expressed in respect of my social media websites are posted without malice toward any individual or entity. 

Rather all my social media content are based upon and supported by true facts, accurate and precise fact which I post with full justification and with full and sufficient clarity in respect of black BT employees and/or CWU members and white BT employees and/or CWU members, all of whom have been instrumental in and fundamentally involved in consistently and constantly pursuing a discriminatory, harassing, victimising, harmful, distressful, alarming and damaging course of conduct toward me within BTs workplace over the period of time stated within all of my social media websites.

I have indicated and identified the subject matter with sufficient clarity throughout the entirety of my social media content and postings. That fact is, I would argue, indisputable and made demonstrably clear within all of my public websites.

I choosing to use the right of every citizen to be offensive towards, to be insulting towards and to heap abusive opprobrium upon numerous black persons and white persons within BT and the CWU is not and cannot be believed to amount to a course of conduct amounting to criminal harassment. 

I believe that expressing offensive, abusive, insulting honest comment, honestly held by me, about the unlawful BT & CWU workplace conduct of persons known to me does not constitute criminal conduct of harassment contrary to the PHA. 

Rather, that in respect of all of my social media content …I believe that in the particular circumstances my pursuit of the course of conduct to be reasonable.  

The fact that another black person(s) or another white person(s) considers my honestly held honestly expressed honest comment to be objectionable and offensive does not / cannot amount to a course of conduct of criminal harassment. 

I am presumed to have the legal right and freedom of any British citizen to express, without malice, honest comment, honestly held about black people and about white people within BT and within the CWU. 

I have exercised that legal right and will continue to so do - within my social media websites. 

As a defendant in criminal prosecution I assert, for the CPS to prosecute me for pursuing a reasonable course of conduct is unconscionable. The CPS’s case against me asserting criminal harassment has no merit, lacks any merit and should, the defendant would argue, be treated as such by a court.

I consider the CPS are attempting to interfere with my right of freedom of expression and restrict my right of freedom of expression and my right to free speech, wholly unjustifiably. My honest comment does not target a particular racial or ethnic group, therefore no interference by the CPS or the court is justified in interfering with and restricting my right to freedom of expression. 

The exact same right possessed by the numerous black persons and white persons I have lawfully, legally, legitimately and justifiably identified and cited by their known bad reputation, by their known bad character and by the unacceptable and reprehensible BT & CWU workplace conduct, maliciously perpetrated against me by those numbers of black persons and white persons who are BT employees and CWU members, within my social media websites.

CPS disclosed prosecution material "evidence" 18/6/13.

 

For the sake of clarity and on a point of fact I choose to "disclose" a fact in respect of CPS information disclosed to me as the defendant at Trial, which I have recently gained possession of in relation to the formal counter allegations of harassment contrary to the PHA 1997 Statement of Witness which I submitted to ATVP on 12/3/13 against a "substantive C1 Grade BT IT Gold User team leader supervisor" white BT employee and ex CWU CCC member ***** *****.

On 10/01/13 ATVP investigating officers referred to BT's internal FS1GC procedure as the BT tribunal and/or BT's tribunal. Which is simply another way of referring to BT's internal FS1GC procedure. No problem.

However:

Nowhere within my 12/3/13 formal Statement of Witness counter allegations document which I submitted to ATVP nor at any other time or point within any document, whether held inside or outside of BT & the CWU, that I have written c.Feb. 2011 to June 2013, have I ever suggested that BME BT employee ***** ****** was either a named witness at Reading Employment Tribunal proceedings and/or gave ...evidence to the tribunal-[ReadingET]-as Mr Jarvis suggests. (sic)  Nowhere!

Nowhere within any document that I have written c. Feb. 2011 to June 2013 have I ever stated that BME BT employee ***** ****** was involved in my Sept. 2011 employment tribunal claim, either as a witness or as a Respondent.

 

I have only ever presented, in writing and/or verbally, that BME BT employee ***** ****** was involved in presenting verbal evidence (i.e. in my honest comment: verbal diaherre drivel "evidence") to BT investigating managers in Aug. & Sept 2011 when that BT employee black person was questioned by white BT line managers/investigating managers in relation to a black BT employee's (i.e. a trustworthy, truthful, decent and real black man, who possesses dignity and self respect as a black man) true, honest, accurate and factual written and verbal evidence I submitted to BT's Formal Stage 1 Grievance - white people protecting white people protecting white people - Complaints and Grievance Appeals internal bullshit!

11. The Claimant - Colin Jarvis - gave oral evidence before us. It should be recorded here that despite having presented in paper as a person who used very strong and intemperate language and demonstrated some powerfully angry attitudes about what had happened to him and how he viewed those persons he considered to have treated him so badly, before the Tribunal he conducted himself in a  moderate and appropriate way and gave evidence clearly and calmly.
